Stop DCYF was created to bring knowledge to New Hampshire families that are struggling to fight against DCYF. It’s well known that DCYF abuses families with made up rules and regulations and the less you know about what they can and cannot do the more they will take advantage of you.

While much of the information within Stop DCYF can be adapted to any state, Stop DCYF was designed specifically for New Hampshire DCYF as the authors are from New Hampshire and have a long history of dealing with New Hampshire DCYF.

Unfortunately, DCYF is staffed by incompetent people that believe they have some authority over the families they work with, this leads to power hungry individuals joining and inevitably causing more harm than good. On Stop DCYF we intend to highlight common areas where DCYF goes above and beyond to harm families even when that requires breaking the law, falsifying evidence and more. DCYF goes against it’s own mission statement by acting in self interest even when that self interest contradicts the well-being of children and families. Often DCYF is seen abusing the courts and legal system in order to further some agenda decided by the worker involved instead of fighting for what’s right for the children and families they are involved with. This is so rampant in New Hampshire that DCYF has been sued and lost several times and currently (2024) has a House Special Committee assigned to investigate them.
Public Service π
DCYF is a state and federally funded program that was designed to work for the public. Despite the fact that the public is paying for it DCYF provides little benefit to the public and in fact regularly works against the public going so far as to have closed public offices, no-answer phone lines and no public employee information of any kind.
Rights π
Despite what many DCYF workers want to belive DCYF workers are not law enforcement and operate with the same rights as any other citizen with the added benefit that DCYF is able to abuse the court system in their favor often times violating several laws and court rules in the process. You should be cautious when interacting with DCYF but do not be afraid to assert your rights.
- DCYF must abide by property access laws like any other person. If you are posted no tresspassing they cannot enter your property. If you ask them to leave they must vacate the premisis immediately.
- DCYF cannot speak to you or your children without a court order, unless they speak to your children in a public place such as a public school just as anyone could do so (more information on this soon).
- DCYF cannot stalk, harrass or intimidate you.
- You can and should press charges against DCYF workers when they break the law.
What to do π
If DCYF contacts you via phone or in person you should
- Hire a lawyer. Don’t wait for DCYF to bring a case against you. The moment someone contacts you, you should be hiring a lawyer.
- Refuse interviews. DCYF has no legal authority to conduct interviews that have not been ordered by the court. Upon first contact DCYF workers will do their very best to convince you that they are legally allowed to speak with you and your children. They are not.
- Record everything. DCYF will tell you their policy is to record as well, this is some high school level tit-for-tat bullshit that they seem to be fixated on. DO NOT speak to any DCYF worker without having physical evidence of the entire encounter and everything that is said therein and DO NOT let them trick you into believing you cannot record them. If they show up to your home you are legally within your rights to record them at your home without their permission so long as it’s in a place that has no reasonable expectation of privacy (ie. bathrooms). Note that New Hampshire requires you to obtain consent from all parties before recording phone calls. The easy solution to this is to ask the DCYF worker if you can record or if you should hang up. If they refuse your recording or continue speaking simply hang up or walk away. DCYF offices are public property inside and out and thus you are legally allowed to record inside DCYF offices although DCYF will attempt to convice you otherwise.
- Report crimes. Just as if the DCYF worker(s) are anyone else, if they commit crimes such as trespassing, harassment or stalking report it to the police. File a no-tresspass order against them as well.
- Refuse to sign. Don’t sign any documents the DCYF worker presents to you regardless of what they say you are required to do.
- Request records. New Hampshire law requires DCYF to release records within 30 days in open cases and 60 days in closed cases from the date a written request for access to case records is received by the district office where the case records are or were located. No, you DO NOT have to fill out and sign any special DCYF forms to access the records.
- Say NO. Unless ordered by a court you DO NOT have to comply with DCYF. You DO NOT have to obey their orders, sign anything they ask you too, or even talk to them at all. You should practice saying NO because DCYF is in the business of tricking people into believing they have some authority over them when they in fact DO NOT.
